The  books  of  Milal  and  Nihal,  the  so-called  Heresiography,  can  and  should  be  read  with  alternative  approaches.   Instead  of  being  read  as  condamnatory  catalogues  of  kufr (unbelief),  i  am  of  the  opinion  that  one  may  by  close  critical  reading  methods  see  sincere,  creative,  serious,  attempts  by  groups  of  the  umma  to  cognize,  apprehend,  come  to  terms  with,  appropriate  the  ineffable  Ultimate  (Tillich).  We  will  benefit  from  a  compassionate  reading  of  these  efforts.

 Samuel  PUFENDORF  

(1632 – 1694)

 

Samuel  Pufendorf  (1632 – 1694),  German,  professor  at  Heidelberg  and  Lund.   Author  of  De  iure  naturae  et  gentium  (1672).  

Pufendorf  was  a  prominent  protagonist  of  natural  law.   He  had  a  more  relaxed  attitude  towords  the  literay  sources, which  for  Hugo  de  Groot  were  authoritative,  but  for  Pufendorf  merely  illustrative.   Pufendorf  strongly  systematised  his  natural  law  and  introduced  many  lasting  general  principles  and  doctrines.   Both  his  system  and  general  principles  influenced  later  codifications.

Ustaad  (R. A.)  constantly  explored  what  being  a  maulawi  is,  what  beign  a  maulawi  means.   From  these  i  present  a  few  ideas.

We  are  recepients  of  Hidaaya  (Guidance),  Nuur (Light),  good  morals,  good  conduct  from  Nabi  Muhammad  (salaamun alaika  Yaa  Rusuulalaah).  We  learn  from  Nabi  Muhammad  cleanliness,  total  abstitance  from  ALL  intoxicants,  helping  and  empowering  the  indigant,  speaking  the  truth,  doing  justice  equally  with  family  and  non - family…

Some  might  say  that  these  are  innate.  Why then  is  there  so  much  crime  in  the  world,  so  much  suffering…

As  recipients  of  this  Hidaaya (Guidance)  we  must  in  some  way  show  our  gratitude  to  Nabi  Muhammad.  This  gratitude  is  complex,  multi-dimensional,  interdisciplinary.  It  takes  many  hands  to  execute  this…   Maulawiyyat  is  part  of  this  exercise.  it  entails  the  indepth  study  of  the  Islamic  Sciences   - Quran,  Hadiith,  Arabic  Grammar,  Rhetoric.  Maulayyit  requires  keeping  relevant  to  new  academic  disciplines.  Its  practitioner  must  explain,  teach,  sermonize,  protest,  plan,  dialogue,  review,  revise.  She/he  must  strive  for  the  betterment  of  human  wellbeing.

i  note  with  ineffable  grief  that  some  from  the  infamous  mutawllie  cast-class  has  divided  the  south  african  umma  into  bantustans 

These  have  created  a  fascism.  They  say  ” We  memons.…“,   “We  X/Y/Z  type  of  gujaraties…“,    “We  Cockneys…“      

We  Memons,  We  XYZ  Gujaraties,  We  Cockneys  put  up  such  and  such  institute,  organization…

Our  guy  is  running  it.

zakaat and sadaqa, conflation of terms

 Zakaat  and  sadaqa,

a  conflation  of  terms

 

 

The  terms  sadaqa  and  zakaat  have  distinct  connotations.  However  in  islamic  literature  tafsir –  sharh, fiqh…  popular  literature,  especially  fundraising  literature,  there  is  a  conflation  of  these  terms.  In  fundraising  literature  this  conflation  is  vulgarly  deliberate  and  commercial.  

Let  us  listen  bery  carefully  to  Allah,  the  Allknowing,  ah-Hakiim -  the  ultimate  strategist. 

Sura 9  :  aaya/verse 60 -    

“Surely  the  SADAQAAT  are  for  the  [it  is  paramount  to  note  that  the  quran  does  NOT  use  the  term  Zakaat  here!]

1.  Fu’qa’raa  : 

2.  Ma’saa’kiin  : 

3.  Aa’mi’luu’na  a’lay’ha  :  those  employed  to  collect  and  manage  the  sadaqaat

4.  al’Mu’al’la’fa’ti  Quluubuhum :  those  whom  the  umma  wishes  to  win  over  to  the  islamic  project

5.  Firr  Riqaab  :  freeing  of  slaves,  abolishing  slavery

6.  the  Ghaa’ri’miin  :  those  imprisoned  in  debt 

7.  fii  Sa’bii’lil’Laah  :  to  realize,  maintain  in  the  islamic  project

8.  Ibnus  Sabiil  :  those  pushed  into  migrancy  due  to  poverty,  drought,  famine…

this  is  an  obligation  (fariidhatan)  from  Allah  and  Allah is  All-Knowing,  full  of  resolve/widom(Hakiim).”   

It  is  sad  that  the  quran  is  so  abused.
